Prenup · default rules

What if we marry without a prenup?

Without a prenup, you are not marrying without legal conditions. Understanding the rules that apply is useful before the wedding.

The hard question

If we do not want a prenup, what should we still do?

There is no single formula for the whole country

Do not assume divorce always means splitting everything equally, or that title in one name always settles ownership. State law, acquisition history, and circumstances can matter.

New York, for example, distinguishes marital and separate property and provides distribution rules. This is a starting point for counsel, not a do-it-yourself divorce calculation.

Three changes worth discussing

Buying a home, reducing paid work for family care, and contributing to a partner’s business may change your financial picture. Ask counsel what happens without an agreement and which records to keep.

Household budgeting, property title, and estate planning address related but different needs. Ordinary notes on this website do not alter those legal rules.

Declining a prenup does not remove the conversation

You can decline an agreement and still discuss debts, savings, work, and security honestly. It need not become a test of love.

Choosing not to sign after receiving advice is also a decision. Understand consequences for each person rather than relying on hearsay.

What to bring to a consultation

Bring questions rather than an assumed legal outcome. Do not upload financial records to this website.

  • Where will we live?
  • What property predates the marriage?
  • What purchases and career changes are planned?
  • Do we need separate estate planning?
